You request credit in the amount and under the terms for which you qualify from the dealer near you conducting business as J.D. Byrider (“Dealer” or “J.D. Byrider”). You certify that you are not currently in any bankruptcy proceedings or other legal proceedings that would adversely affect your ability to repay the credit requested, and that the information you have provided in this application is complete and accurate. You understand and agree that Dealer may submit your application to the finance company conducting business as Car Now Acceptance Company (“CNAC”) for consideration and to other potential creditors. You understand and agree that Dealer and CNAC, when evaluating your application and when reviewing or collecting any credit extended, may investigate your credit, income, and employment history, obtain information about you from persons identified with you application (references, employers, creditors, and landlords), obtain information about you available through public records, and obtain consumer reports about you from credit reporting agencies to the extent permitted by applicable law. If you finance your purchase with Dealer and CNAC and provide information about other persons who may be interested in financing a purchase from Dealer, you agree that Dealer may talk to such persons about your decision to purchase and finance a vehicle from Dealer. If you have been referred to Dealer by another person who has purchased a vehicle from Dealer, you agree that Dealer may tell that person about your decision to apply for and/or obtain credit for purchasing a vehicle.

Married Persons in Community Property States: If you are married and living in a community property state, you agree this credit is being incurred in the interest of your marriage or family.

Notice of Negative Information Furnishing: We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.

Consent for Communications: By providing the number of your land line, cell phone or other wireless device and your email address, you expressly consent and agree that we and any of our affiliates, agents, service providers or assignees may call you, using an automatic telephone dialing system or otherwise, leave you a voice, prerecorded, or artificial voice message, or send you a text, e-mail, or other electronic message for any purpose related to the servicing or collection of any account that you may establish with us or for other informational purposes related to your account (each a “Communication”). You agree that we and any of our affiliates, agents, service providers or assignees may call or text you at any telephone number associated with your accounts, including cellular telephone numbers, and may send an e-mail to any email address associated with your accounts that you provide to us now or in the future. You also agree that we and any of our affiliates, agents, service providers or assignees may include your personal information in a Communication. We will not charge you for a Communication, but your service provider may. In addition, you understand and agree we and any of our affiliates, agents, service providers or assignees may always communicate with you in any manner permissible by law that does not require your prior consent. You agree that we may monitor and record any telephone calls to assure the quality of our service or for other reasons. You acknowledge and confirm that you have the authority to provide this consent because you are either the subscriber of the telephone number(s) or you are the non-subscriber customary user who has authority to provide this consent. If you change your telephone number(s), you agree to contact us immediately to advise us of any such change.

Notice to California Residents: An applicant, if married, may apply for a separate account. If adverse action as defined by Section 1785.3 of the California Civil Code is taken against you and it is based, in whole or in part, on any information contained in a consumer credit report, you have the right to obtain within 60 days a free copy of your consumer credit report from the consumer reporting agency. You have the right as described in Section 1785.16 of the California Civil Code to dispute the accuracy or completeness of any information in a consumer credit report furnished by the consumer credit reporting agency.

Notice to New York and Rhode Island Residents: In connection with your application for credit, a consumer report may be obtained which contains information on your credit worthiness, credit standing, credit capacity and general reputation. If you request, you will be informed whether a consumer report was obtained and if so, you will be given the name and address of the consumer reporting agency which furnished the report. If your application is granted, subsequent consumer reports may be obtained in connection with any update, extension of renewal of credit.
